Our cake and ordering contracts are legal binding contracts, please read them carefully before signing.

 

Cancellation and Refund Policy

You may cancel your cake order IF your wedding is canceled in its entirety. If your cake has been paid in full, no refunds will be given unless there are exceptional circumstances. If your wedding has been canceled, we will investigate to make sure the wedding has been canceled and determine if there are any exceptional circumstances that would require a refund to prevent fraud to us. Exceptional circumstances may include but not be limited to a death of one of the wedding party or events of that nature. In no event will the 50% retainer be refunded. If the wedding has not been canceled as stated, we will deal with the wedding on a case to case basis and try to offer solutions as best we can.

If you find that the cake that you ordered is too large for the number of guests that you expected, you may downsize the cake no later than 30 days prior to the event. An adjustment will be made to the price of the cake if the cake has not been paid in full. If there is a small balance left to pay and the downsized cake price requires a refund, or the cake is paid in full, there will be no refund given for the difference.

Refunds are given only in exceptional circumstances as deemed appropriate by Cake Designers.

If you place an order for a wedding cake, you are contracting our services and unless definitive proof that the wedding has been canceled, we will offer a credit for a future cake that must be used within 6 months of the cancellation.

The buyer also agrees that upon final payment and pickup or delivery of the order, that they accept the product “as is” and no refunds will be issued.

Rescheduling

If event date needs to be rescheduled, all deposits would be held and transferred to the new event date unless product process has begun. The product cost will be forfeited and a new contract will need to be initiated. A new contract will be required to reschedule, and current updated pricing would be reflected in the price of the cake. In the event that the event date is rescheduled to a date that Cake Designers is not available due to a full schedule or other previous commitments, the deposit will be forfeited and the cake will not be be produced for the new event date.

If you are rescheduling, before you commit to a new date with your venue, check with all your vendors to make sure they are available for the date.

Returned Checks

Returned checks are subject to a $25 fee.

Cake Tasting/Consultation Policy

We offer a FREE 2 hour consultation/taste testing appointment for 2 adults to custom design your dream wedding cake. Additional adults will incur a $10 fee per person, maximum of 4 people total. This fee will be waived if an order for a cake is placed. If you need another appointment there is a $25.00 charge for each ½ hour. This fee will be applied to the total of your cake order once an order has been placed.

Wedding Cakes – Tastings include a choice of 3 to 5 cake flavors, 12 different fillings, and choice of 2 icings, rolled fondant and butter-cream.

All price quotes given at the consultation are good for 15 days.

Once you have a signed contract with Cake Designers to make your wedding cake, you will have up to 30 days prior to your event to make minor changes to your cake including, number of servings, cake flavors and filling flavors. Some changes may affect the price of the cake.

Deposits

A 50% non-refundable retainer on the cake is required to retain the event date. We accept major credit cards, checks, cash app and cash.

Payment Policy

After the initial 50% non-refundable retainer has been made, the remaining balance can be paid in installments of Monthly payments on the wedding cake up to 30 days prior to the event. 30 days prior to the event the balance due must be made in full. Any payments less than 30 days of the event must be paid with CASH and a $5.00 per day late charge will be assessed! If final payment has not been received 7 days prior to the event the cake will not be made and no refunds will be given. Failure to pay the balance due will result in the cancellation of your order.

Grooms Cakes

The prices of grooms cakes start at a minimum of $275.00 and are priced according to the complexity of your chosen design. Different mediums of icings such as rolled fondant, butter-cream, gumpaste, chocolates and modeling chocolate also factor into the price of the cake.

Artistic License Disclaimer

Every cake we make is hand-made. Decorative finishes are done by hand and are subject to the artistic interpretation of our professional cake designer. You may provide us with a photograph for inspiration and duplication; however, we make no claims for exact duplication of the work done by other cake decorators.

If ribbons are part of your cake design, we suggest that you provide the ribbon for the cake at least one month prior to the event. This ensures that the ribbon is the exact color and size you desire. Once we know the size and shape of your cakes, we will let you know the amount of ribbon to purchase.
It is also up to the bride/groom to provide color swatches for us to use. We will strive to match your colors as close as possible. Keep in mind that some colors may change or alter due to lighting/sunlight.
When working with food grade dyes, perfect color matches are sometimes impossible. Dark colored icings have a tendency to darken further in time, humidity and heat. The darker colors may also stain teeth and have some residual flavor.

If there are any known food allergies for your guests that would be include in your cake, you must notify us in writing.

Flowers

Cake Designers will place fresh or silk flowers, greenery, ribbon and topper that you provide.

Please work with your florist to make sure any fresh flowers to be used on the cake are free of pesticides and sprays.

Fresh stems and bare wires should never be inserted into the cake for food safety reasons.

Returnable Items Deposit

This will vary based on the style and design of cake chosen.

It is 100% refunded if all supplies are returned, clean and undamaged within 2 days after the wedding date.

Mutual Non-Disparagement

Client and the Company mutually agree to forbear from making, causing to be made, publishing, ratifying or endorsing any and all disparaging remarks, derogatory statements or comments made to any party with respect to either of them. Further, the parties hereto agree to forbear from making, or causing any other party to make, any public or non-confidential statement with respect to the any claim or complaint against either party without the mutual consent of each of them, to be given in advance of any such statement.

Force Majeure

In the event that either party is unable to perform its obligations under this Agreement as a result of a Force Majeure, neither party shall be liable to the other for direct or consequential damages resulting from lack of performance. “Force Majeure” shall mean fire, earthquake, flood, act of God, strikes, pandemics, vehicle accidents or breakdowns, work stoppages, or other labor disturbances, riots or civil commotions, litigation, terrorism and/or terroristic threats, war or other act of any foreign nation, power of government, or governmental agency or authority, or any other cause like or unlike any cause above mentioned which is beyond the control of either party.

Limitation of Liability: In no event will the owners of Cake Designers, employees, or any family members be held liable for any losses or judgements to exceed the actual dollar amount that was transferred from client to Cake Designers due to this contract.
